Acknowledgment
These Terms govern your use of the LumaWell mobile application and related content and services (the “Service”). By installing, creating an account, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Eligibility
To use LumaWell, you must be 13 years or older. If you are between the ages of 13 and 17, you must have a parent or guardian's guidance. You are responsible for providing accurate account information, keeping it updated, and maintaining the confidentiality of your login credentials, and you acknowledge that you are responsible for all activity under your account.
Wellness-Only; Health Knowledge, Not Medical Care
LumaWell provides wellness support and health knowledge (including expert insights) for educational purposes. It does not provide medical care, diagnosis, or treatment and is not a medical device or a substitute for professional care. For medical questions, consult a clinician. In an emergency, call 911 (or your local emergency number).
Accounts and Security
Provide accurate information and keep it updated. You are responsible for all activity under your account and for protecting your login credentials. You may request account deletion in-app (where available) or by contacting us.
License and Acceptable Use
We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes, subject to these Terms and applicable app-store rules. You agree not to (a) copy, modify, or create derivative works; (b) reverse engineer; (c) interfere with security or access controls; (d) use the Service in any unlawful or harmful way.
User Content
You retain ownership of content you submit (e.g., logs, notes, goals) (“User Content”). You grant us a worldwide, royalty-free license to host, store, process, and display User Content solely to operate, secure, improve, and personalize the Service. You are responsible for your User Content and must not submit illegal, infringing, or harmful material.
Virtual Items and Rewards
Badges, points, or other virtual items have no cash value, are non-transferable, and may be modified or discontinued at any time.
Subscriptions, Trials, and Payments
Some features may require a paid subscription or in-app purchase. Pricing and terms are shown before purchase. Apple App Store and Google Play process payments; their terms and refund policies apply. Trials (if offered) convert to paid unless canceled before renewal. Manage or cancel via your device’s account settings.
Third-Party Services and Links
We may integrate third-party services (e.g., analytics, crash reporting, subscriptions). Their terms and privacy policies may apply. We are not responsible for third-party content or services outside our control.
Intellectual Property
The Service and its content (excluding your User Content) are owned by us or our licensors and are protected by IP laws. No rights are granted except as expressly stated.
Feedback
If you share ideas or suggestions, you grant us a perpetual, worldwide license to use them without obligation.
Termination
You may stop using the Service at any time. We may suspend or terminate your access for violation of these Terms, risk of harm, legal compliance, or if we discontinue the Service. Upon termination, your license ends.
“AS IS” Disclaimer
The Service is provided “AS IS” and “AS AVAILABLE.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted, error-free, or secure operation.
Limitation of Liability
To the maximum extent permitted by law, we and our affiliates will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, revenue, or data. Our aggregate liability for claims relating to the Service will not exceed the greater of US$100 or the amount you paid to us for the Service in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold us harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.
Governing Law; Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Courts in San Mateo County, California have exclusive jurisdiction for disputes not subject to arbitration.
Optional arbitration clause: Any dispute shall be resolved by binding arbitration on an individual basis under JAMS/AAA rules. Class actions and jury trials are waived. (Delete this paragraph if you do not want arbitration.)
Severability and Waiver
If any provision is unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver.
Changes to These Terms
We may modify these Terms. If changes are material, we will provide notice (e.g., in-app or email). Continued use after changes means you accept the updated Terms.
