Agreement to these Terms
These Terms of Service ("Terms") govern your use of the LumaWell mobile application and related services (together, the "Service"). By creating an account, accepting these Terms, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
Your use of the Service may also be subject to the rules and terms of the app store through which you downloaded LumaWell.
Eligibility
You must be at least 13 years old to use LumaWell. If you are between 13 and 17, you should use LumaWell only with the guidance of a parent or legal guardian. By using the Service, you represent that you meet these requirements.
Wellness support—not medical care
LumaWell provides general wellness support, educational information, progress tools, and exercises intended to help people change vaping habits. LumaWell does not provide medical advice, diagnosis, treatment, counseling, or emergency services. It is not a medical device and is not a substitute for care from a qualified healthcare professional.
Do not delay or disregard professional medical advice because of information provided through LumaWell. If you believe you may be experiencing a medical or mental-health emergency, call 911 or your local emergency number.
AI-assisted features
Some LumaWell features, including Luma Companion, Weekly Reflection, Recovery Insights, and personalized recommendations, use artificial intelligence. These features may use information you provide and selected information from your LumaWell activity to generate personalized responses.
AI-generated content may be incomplete, inaccurate, or inappropriate for your circumstances. It is provided for general wellness support only and should not be treated as medical advice, a clinical assessment, or a guarantee of results. You remain responsible for decisions you make based on the Service. For more information about how data is used for these features, see our Privacy Policy.
Your account
You agree to provide accurate information and keep it reasonably current. You are responsible for protecting your login credentials and for activity under your account. Notify us promptly at support@lumawell.app if you believe your account has been accessed without permission.
You may request deletion of your account through the in-app account controls or by contacting legal@lumawell.app. Some information may be retained where required by law or for legitimate purposes described in our Privacy Policy.
License and acceptable use
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use.
You may not:
copy, modify, distribute, sell, lease, or create derivative works from the Service except as permitted by law;
reverse engineer or attempt to obtain the Service's source code except where applicable law permits it;
bypass security, access controls, subscription restrictions, or usage limits;
interfere with the Service or use automated methods to access it without our permission;
use the Service to violate the law, infringe another person's rights, or submit harmful, abusive, deceptive, or unlawful material; or
use AI features to generate or facilitate harmful, illegal, or abusive content.
Content you provide
You retain ownership of the information and content you submit to LumaWell, such as goals, notes, check-ins, craving logs, and messages ("User Content"). You give Brightness Labs a limited, worldwide, royalty-free license to host, store, process, reproduce, and display your User Content only as reasonably necessary to operate, secure, maintain, personalize, and improve the Service.
You are responsible for your User Content and must have the right to submit it. Do not submit content that is unlawful, harmful, or infringes another person's rights.
Subscriptions, free trials, and payments
Some features require a paid subscription. Available plans, prices, billing periods, and any free-trial terms are shown before you subscribe. Purchases are processed by Apple through your App Store account; Brightness Labs does not receive your full payment-card details.
Subscriptions automatically renew for the same billing period unless canceled at least 24 hours before the end of the current period. Your App Store account will be charged upon confirmation of purchase and for each renewal. You can manage or cancel your subscription in your Apple account settings. Deleting the app or your LumaWell account does not automatically cancel an active subscription.
Free trials, when offered, are subject to the eligibility and terms shown at checkout. Unless canceled before the trial ends, a trial converts to the selected paid plan. Refunds are handled under Apple's policies. You may use Restore Purchases in the app to restore an eligible purchase.
We may change subscription prices or features as permitted by law and app-store rules. Any required notice or consent will be provided through the applicable app store or the Service.
Badges and virtual rewards
Badges, streaks, points, certificates, and other virtual rewards have no cash value, are not transferable, and do not represent medical outcomes. We may modify or discontinue them as the Service evolves.
Third-party services and links
The Service relies on third-party providers for functions such as authentication, cloud hosting, notifications, AI-assisted features, and subscription management. It may also link to third-party content. Third-party services are governed by their own terms and privacy practices, and we are not responsible for services outside our control.
Intellectual property
The Service, including its software, design, text, graphics, characters, trademarks, and other content other than User Content, is owned by Brightness Labs or its licensors and is protected by intellectual-property laws. These Terms do not grant you any right to use our names, logos, or other brand elements.
Feedback
If you send us ideas or suggestions about LumaWell, you allow us to use them without restriction or compensation to you. This does not transfer ownership of your User Content.
Changes, suspension, and termination
We may update, suspend, or discontinue part or all of the Service. You may stop using LumaWell at any time. We may suspend or terminate access if you materially violate these Terms, create a risk of harm, misuse the Service, or if suspension is reasonably necessary for security or legal compliance.
Sections that by their nature should survive termination—including ownership, disclaimers, limitations of liability, and dispute terms—will remain in effect.
Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available." Brightness Labs disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, secure, or that using it will produce a particular result.
Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
Limitation of liability
To the maximum extent permitted by law, Brightness Labs and its affiliates, officers, employees, agents, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data, arising from or related to the Service.
To the maximum extent permitted by law, our total liability for claims arising from or related to the Service will not exceed the greater of US$100 or the amount you paid to Brightness Labs for the Service during the 12 months before the event giving rise to the claim.
Nothing in these Terms limits liability that cannot legally be limited.
Indemnification
To the extent permitted by law, you agree to indemnify and hold Brightness Labs and its affiliates, officers, employees, and agents harmless from claims, damages, liabilities, and reasonable costs arising from your unlawful misuse of the Service, your violation of these Terms, or your violation of another person's rights.
Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in San Mateo County, California, except where applicable consumer law gives you the right to bring a claim elsewhere.
Changes to these Terms
We may update these Terms to reflect changes to the Service, our practices, or applicable law. We will post the updated Terms and revise the effective date. If a change is material, we will provide additional notice when reasonably required. Your continued use of the Service after the updated Terms take effect means you accept them, to the extent permitted by law.
General terms
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition, reorganization, or sale of assets. These Terms and the Privacy Policy constitute the agreement between you and Brightness Labs concerning the Service, subject to applicable app-store terms.
